What is the Committee of Adjustment?

The Committee of Adjustment (COA) is an independent quasi-judicial body that makes decisions under the Planning Act on applications for minor variance, consent, and permissions to extend or enlarge legal non-conforming uses.

The committee is made up of five citizens who are appointed by Council. This committee hears applications and votes to approve or refuse the requests before them, hearings are held monthly.

Minor Variances

A minor variance is an application process that allows property owners to seek permission to make minor changes to the Zoning By-law to accommodate alterations and developments on their property that do not conform to the in-effect Zoning By-law.

Minor Variance applications may include but are not limited to requests seeking relief from the building setbacks, building height, driveway width, lot coverage etc.

Consent Applications

Committee of Adjustment is authorized by Council to grant consents. A consent approval enables certain transactions to occur relating to the subdivision of land. These transactions most commonly include:

Creation of a new lot (land severance)
Lot Addition (lot line adjustments, lot additions and lot extensions)
Easements (right-of-way)
Validation of title (corrections to deeds or property descriptions)
Mortgage/Charge (register a mortgage over part of a property)

Please note that prior to submitting a consent application a pre-consultation is highly recommended.

Hearing Details

Committee of Adjustment Meetings are held as HYBRID HEARINGS, with virtual and in-person participation (Council Chambers, King Township Municipal Centre).

Please note that viewing the hearing will not provide you with the ability to speak, should you wish to speak to a matter please contact the Secretary Treasurer at COFA@King.ca to request this.
The Committee of Adjustment Agenda containing planning reports, public correspondence and application materials can be found on our website the Friday prior to the hearing by clicking onto the corresponding hearing date found on the online calendar.
Deferrals can be requested by any party and the decision to grant a deferral is at the sole discretion of the Committee of Adjustment. A deferral request by an applicant/agent that takes place at the hearing, will be subject to an additional re-circulation review fee if granted by the committee.
Anyone wishing to speak to the Committee of Adjustment Virtually, must register by contacting the Secretary Treasurer at cofa@king.ca , no later than noon on the Friday prior to the scheduled hearing. When your request to speak is received, a confirmation message and instructions for providing a deputation virtually at the meeting will be provided.
Anyone wishing to speak to the Committee of Adjustment in-person, should register by contacting the Secretary Treasurer at cofa@king.ca. You may also register at the hearing in Council Chambers by completing a deputation registration form and providing it the Secretary Treasurer.
Only participants wishing to speak live on the night of the meeting to the Committee of Adjustment members will need to register for the meeting. If you only wish to observe and watch the meeting, but not speak, you can do by clicking the following link: https://www.king.ca/meetings

NEW: Steps to submit a Committee of Adjustment Application using the online submission portal

This step of review provides your proposal with a zoning examination and confirmation of variances required upfront. Although not required, this step has been designed to ensure your application moves through the process of review seamlessly, which means attending your hearing with an application that has undergone a more extensive review.
A Township Zoning Examiner will review your plans / proposal in detail, for the purpose of confirming variances required to facilitate your proposed development.
You will receive confirmation of your submission within 3-5 business days.
The fee for this review is $65.00

Minor Variance Zoning Review
IMPORTANT NOTES:
You must register for an online account to use the online portal system. Once you are setup you can follow the steps below to successfully submit your request for a Minor Variance Zoning Review.

1) Select "Apply for Planning Application or Zoning Services".
2) Choose your project type, for this review you will select "Minor Variance".
3) Enter the subject property address only into the field titled "Project Descriptive Name".
4) Enter any related Comments.
5) Under "Search for Planning Types" select 'COA Zoning Review (Confirmation of Variances)'

A Pre-consultation meeting is not required however it is highly recommended prior to the submission of a formal Committee of Adjustment application. This meeting allows for staff to review their comments with you prior to hearing, reserving a time where discussions with internal staff can take place prior to hearing.
MINOR VARIANCE PRE-CONSULTATION
Post meeting a Pre-Consultation Letter will be issued confirming discussions and listing out further steps which may have been recommended. This summary is valuable when preparing your formal application submission for review from staff and consideration from the Committee.
The fee for a pre-consultation meeting is $200.00.
You will receive confirmation of your request within 3-5 business days.

CONSENT PRE-CONSULTATION
Looking to schedule a Pre- Consultation for your Committee of Adjustment related CONSENT application?
This tailored pre-review is referred to as a CAP meeting (Collaborative Application Preparation). CAPS are categorized as follows:
MINOR CAP (Pre-consultation) Proposal
Any pre-consultation meeting which does not require external agencies, other departments (i.e. requires only Township Planning staff in attendance). Fee for this initial review is $800.00 (Stage 1)
- Residential: the creation of up to 3 lots/units; and/or
- Non-residential: alterations/expansions of existing buildings, parking, uses, etc.; new development less than 300 square metres gross floor area and/or,
- Any form of Consent being requested (severance, easements, property boundary line adjustments/conveyance, changes to legal non-conforming uses, leases for more than 21 years, and/or validation of title)
- Change in use with no new site development
MAJOR CAP (Pre-consultation) Proposal
Any pre-consultation meeting which will require external agencies, other departments (i.e. Conservation Authority, Region of York, Ministry etc). Fee for this initial review is $1100.00 (Stage 1)
- Residential: the creation of 4 lots/units or more; and/or
- Non-residential: new development greater than 300 square metres gross floor area and/or,
- Change in use which includes new site development
Collaborative Application Preparation (CAP)
IMPORTANT NOTES:
You must register for an online account to use the online portal system. Once you are setup you can follow the steps below to successfully submit your request for a CAP Pre-consultation meeting.

2) Choose your project type, for this review you will select "Collaborative Application Preparation".
3) Enter the subject property address only into the field titled "Project Descriptive Name".
4) Enter any related Comments.
5) Under "Search for Planning Types" select 'Major' or 'Minor' CAP (see above for descriptions).
At the direction of your Planner and once you have obtained a Minor Variance Zoning Review and have attended your COA Pre-Consultation meeting, you will be ready to submit your formal COA application. You can do so using the link below:
