Take notice that the Council of the Corporation of the Township of King passed By-law Number 2024-079, being a by-law to adopt Amendment No. 4 to the Official Plan of the Township of King, on the 15th day of October, 2024, under Section 17 and 22 of the Planning Act, R.S.O, 1990, as amended. The approval authority is the Township of King, 2585 King Road, King City, ON, L7B 1A1.

Amendment No. 4 to the Official Plan concerns two parcels of land located on the east side of Banner Lane, south of King Road, municipally known as 31 and 37 Banner Lane, King City, ON.

All submissions from the public, staff and external agencies were considered as part of the decision-making process. Public consultation took place in the form of a public meeting held by Council on January 8, 2024, that was a formal, statutory meeting under the Planning Act. All comments received were considered in municipal planning staff reports and were made available to the public both on our website (www.king.ca ) and in person. The comments were identified, discussed, and where appropriate, were addressed at the Council meeting on April 29, 2024, and within Planning Division Report No.’s GMS-PL-2024-011. Comments received and considered were summarized within the said report. The report is available on the Township’s website www.king.ca. More specifically, based on these comments, Council is satisfied that all matters have been appropriately addressed and as such, Council adopted the Official Plan Amendment, which is available on the Township’s website at www.king.ca.

Take notice that an appeal to the Ontario Land Tribunal (OLT) in respect to all or part of this Official Plan Amendment may be made by filing a notice of appeal with the Township Clerk either via the OLT e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Township of King as the Approval Authority or by email at clerks@king.ca, no later than 4:30 p.m. on Monday, November 18th, 2024. Should this date fall on a holiday or weekend, you will have until 4:30 p.m. of the next business day to file your appeal.  Appeals filed after 4:30 p.m., either in person or electronically, will be deemed received on the next business day. The appeal fee of $1,100 per application being appealed, can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the OLT or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is unavailable, you can submit your appeal to clerks@king.ca .

Any appeals filed with the OLT, must also submit the Clerk’s Division Administrative processing fee of $250.00 per application, and the Planning Division’s Administrative processing fee of $412.00 per application, payable to the Township of King, no later than 4:30 p.m. on Monday, November 18th, 2024. These fees may be paid through King’s online payment portal at (www.king.ca/OLT), or by forwarding two separate cheques payable in the amounts noted above, to the Township of King, Attn: Township Clerk, 2585 King Road, King City, ON, L7B 1A1.

No person or public body shall be added as a party to the hearing of the appeal unless, before the Official Plan Amendment was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the OLT there are reasonable grounds to add the person or public body as a party.

The proposed Official Plan Amendment is solely a decision of the Council of the Township of King and is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Explanatory Note By-law 2024-079: 

By-law Number 2024-079 is a by-law to adopt Official Plan Amendment #4 for the Township of King Planning Area. Specifically, the amendment concerns two parcels of land, municipally known as 31 and 37 Banner Lane, located on the east side of Banner Lane, south of King Road. The subject properties measure approximately 1,926 m2 and 1939 m2 respectively and currently support one single detached dwelling on each property.

Amendment #4 amends the Township of King Official Plan, ‘Our King’ (2019), as amended on a site-specific basis to include a village site specific policy exception, to permit the creation of a new residential lot with a single detached dwelling. An implementation by-law will provide the site-specific provisions and incorporate Holding (H) provisions that are to apply to the subject properties.
